A British woman injured in a fall during a visit to the Two Oceans Aquarium at the Waterfront in 1995 launched an amendment application in the Cape High Court on Wednesday after the wrong defendant's name appeared on the original summons for damages.
Lynne Embling, 52, is suing the aquarium for damages after she slipped and injured her leg during her December 1995 visit there.
Embling claimed her fall was caused as a result of "negligence" on the part of the aquarium when she tripped over a badly lit step.
Her British employer, TLC Products and Services, is also claiming for loss of income and profit as a result of Embling's "considerable period of absence" after her accident.
However, when the summons was issued to the aquarium in 1998, the Two Oceans Aquarium was referred to as a closed corporation instead of a trust.
The aquarium's lawyer is opposing the amendment application because the wrong legal persona was cited in the original lawsuit.
Judge Belinda van Heerden will rule on the application on Thursday.
